Terms & Conditions
The basis on which we provide this website, our estimates and the work we carry out.
About these terms
These terms cover your use of this website and the basis on which Building Care Services Ltd provides estimates and carries out work. Our address is Kimberley Business Park, Leaves Green, Keston, BR2 6HL.
By using this website you accept these terms. If you do not accept them, please do not use the site.
Information on this website
The content of this website is provided for general information about our services. We take care to keep it accurate, but it does not amount to advice about your particular property or circumstances.
Descriptions of methods, materials and typical projects are illustrative. What is right for your home is confirmed at a site assessment, not from a web page.
Nothing on this website is an offer capable of acceptance. A contract exists only when we have provided a written estimate and you have accepted it.
Enquiries and estimates
Enquiries submitted through this website are requests for us to contact you. Submitting one does not commit you to anything.
We provide a free home assessment and a written estimate with no obligation. An estimate sets out the work, specification and sequence we propose.
Estimates are based on what is visible and reasonably foreseeable at the time of assessment. Where work uncovers something that could not reasonably have been seen, hidden structural defects, unexpected services, or concealed damp or decay, for example, we will tell you before carrying out any additional work, and any change in price will be agreed with you first.
Unless stated otherwise on the document, an estimate remains open for the period stated on it.
Carrying out the work
You agree to provide safe and reasonable access to the property for the duration of the work, and to tell us about anything relevant that we could not be expected to know, including known defects, asbestos surveys, service runs and any tenancy, leasehold, freeholder or management-company requirements.
Where the work requires consent from a landlord, freeholder, managing agent or local authority, obtaining that consent is your responsibility unless we have agreed in writing to deal with it.
We will agree dates with you in advance. Programmes can be affected by matters outside our control, including weather, supply of materials and the discovery of unforeseen conditions. We will keep you informed if a date has to change.
Payment
Payment terms, including any stage payments, are set out in the estimate or contract documents for your project and are agreed before work begins.
Any variation to the agreed work will be confirmed with you, including its effect on the price, before it is carried out.
Cancellation
Where you engage us as a consumer following a visit to your home or another off-premises discussion, you have a statutory right to cancel within 14 days of entering into the contract.
If you ask us in writing to begin work within that 14-day period, and then cancel, you may be required to pay for the work and materials supplied up to the point of cancellation.
To cancel, contact us on 07878 938265 or at enquiries@easy-gardens.co.uk.
Your legal rights
Where you deal with us as a consumer, we must carry out the work with reasonable care and skill, within a reasonable time, and for a reasonable price where one has not been fixed. Nothing in these terms removes or limits your rights under the Consumer Rights Act 2015 or any other legal rights you have that cannot be excluded.
Liability
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded or limited by law.
Subject to that, we are not responsible for losses that were not reasonably foreseeable at the time the contract was made, or for pre-existing defects in a property that are unrelated to the work we carry out.
Complaints
If something is not right, tell us as soon as possible on 07878 938265 or at enquiries@easy-gardens.co.uk. We would always rather hear about a problem while we can still put it right.
Intellectual property
The text, layout, logo and images on this website belong to us or are used with permission, and may not be reproduced without our written consent.
Governing law
These terms and any contract between us are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
